Members are advised that today, 23 August 2024, the Construction and General Division of the Construction, Forestry and Maritime Employees Union and all its branches - including the WA and ACT branches, have been placed into administration.
The Commonwealth Attorney-General, The Hon Mark Dreyfus KC MP, released a statement this morning confirming that he has determined a written scheme of administration, and also that the General Manager of the Fair Work Commission has appointed Mr Mark Irving KC as the administrator and contacted Mr Irving to notify him of his appointment. This statement is attached below. Further to this, Mr Murray Furlong, General Manager of the Fair Work Commission, has confirmed the appointment of Mr Mark Irving KC as Administrator. The scheme of administration of the Construction and General Division of the CFMEUtakes effect immediately. The Scheme can be viewed at this link.
The Scheme is comprehensive and effectively grants the Administrator total control of the union to enable him to promote compliance by the Construction and General Division with the laws (including workplace laws) of the Commonwealth, the States and the Territories.
For the avoidance of any doubt, the following CFMEU NSW offices have been vacated by the Scheme, effective immediately:
- Divisional Branch Secretary - Darren Greenfield
- Divisional Branch Assistant Secretary – Vacant (formerly held by Michael Greenfield)
- Divisional Branch Assistant Secretary - Robert Kera
- Divisional Branch President - Rita Mallia
This is a watershed moment for the NSW construction industry. In the weeks to come Master Builders will be conducting a series of webinars and events to help inform our Members in relation to the Scheme, and in relation to the enterprise agreements which have recently been made with the CFMEU NSW.
