The Government has recently introduced to Parliament the Industrial Relations Omnibus Bill. The Bill proposes a series of changes to the Fair Work Act and related laws. Some of the proposed changes include a new definition of casual employment and a new criminal offence for underpayments.
Other proposed changes:
- a new definition of casual employment,
- improvements to Enterprise Agreement making and approval processes,
- Greenfields Agreements being able to apply for to 8 years on major projects;
- greater flexibilities for some Modern Awards (but not including Construction Awards) and
- a new criminal offence for underpayments that are dishonest and systematic.
- The proposed Bill will be considered by Parliament in early 2021 at the earliest.
- Until then, the existing laws continue to apply. Employers do not need to make any changes at this time. Master Builders will continue their advocacy efforts and will provide updates as needed.
