MEDIA RELEASE: Master Builders Association of NSW acknowledges the Minns Government’s application to the Industrial Court seeking orders for the appointment of an administrator the NSW Branch of the CFMEU.

The CFMEU NSW Branch has dual registration under both the federal and NSW industrial relations system and therefore requires legal and legislative action at both a state and federal level.

Executive Director Brian Seidler said: “Master Builders welcomes the NSW Government for taking this vital step to help ensure the ongoing integrity and viability of the industry in our state.

“The appointment of an administrator will help bring about changes to the union.”

The NSW Government will also introduce legislation to amend the Industrial Relations Act 1996 to provide for the appointment of an administrator for the CFMEU.

“We urge all parties to support and not delay this important piece of legislation,” Mr Seidler said.

Today’s announcement follows the lodgement of the Fair Work Commission’s application to the Federal Court on Friday.

Mr Seidler added: “While these applications are an important first step towards tackling criminality and the poor culture within the industry, this is a once in a generation opportunity that cannot be missed.

“Master Builders is calling for the Federal Government to establish one central overarching body to coordinate the various inquiries and investigations currently underway across all levels of government.

“We urge the NSW Government to follow through on their commitment of a thorough investigation of current CFMEU pattern Enterprise Bargaining Agreements and ensure they have been genuinely agreed to.

“Master Builders will continue to encourage contractors in the industry to not sign the pattern agreement.

“Futhermore, steps should be taken through procurement policies to ensure that any tenders awarded for building works have been entered into genuinely, free from coercion, intimidation and duress.

“Fixing this once and for all can only be achieved through a comprehensive and coordinated approach involving permanent changes to create a range of industry specific laws, enforced by one dedicated industry specific regulator with the tools and powers it needs.

“It’s clear existing regulators and law enforcement units cannot operate in silos and require collective resources and the removal of legislative barriers.

“We all, whether as employers, workers or union members, deserve to work in an industry that is lawful, safe and free from corruption, coercion, bullying and intimidation.”
